These Terms of Service ("Terms") govern your access to and use of the website smilejet.app and all related services (collectively, the "Service"), operated by Smilejet LLC ("SmileJet," "we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms at any time. Continued use of the Service after the effective date of any revision constitutes your acceptance of the updated Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service you represent and warrant that you meet this requirement and that any information you provide is accurate and complete. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

SmileJet is a dental tourism marketplace that connects patients with verified dental clinics worldwide. We provide informational content, clinic listings, quote-request facilitation, and related tools to help users make informed decisions about dental treatment abroad. SmileJet is a technology platform — we are not a healthcare provider, dental practice, or medical institution, and we do not provide medical advice.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at [email protected] if you suspect unauthorized access.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. WhatsApp & Messaging via Meta Cloud API

SmileJet uses the Meta WhatsApp Cloud API to send transactional and service-related messages (e.g., quote confirmations, clinic follow-ups). By providing your WhatsApp number and opting in to messaging you agree that:

• Messages are sent through Meta Platforms, Inc. infrastructure and are subject to WhatsApp's Terms of Service and WhatsApp's Privacy Policy.
• SmileJet does not use WhatsApp messages for unsolicited marketing without your explicit consent.
• You may opt out of WhatsApp messages at any time by replying STOP or contacting us at [email protected].
• Standard carrier message and data rates may apply.

5. User Content

You may submit reviews, comments, photos, or other content ("User Content") to the Service. By doing so you grant SmileJet a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, and display that User Content in connection with operating and promoting the Service.

You represent that your User Content:

• Does not infringe any third-party intellectual property, privacy, or other rights.
• Is not false, misleading, defamatory, obscene, or otherwise unlawful.
• Does not contain malware, spam, or unsolicited promotional material.

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful to users, clinics, or the Service.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Scrape, crawl, or systematically extract data from the Service without our prior written consent.
• Attempt to gain unauthorized access to any part of the Service or its underlying systems.
• Submit false, fraudulent, or misleading information, including fake clinic reviews.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to transmit spam or unsolicited commercial communications.

7. Relationship with Clinics

SmileJet facilitates connections between patients and dental clinics. We do not employ the clinics listed on the Service, and we are not responsible for the quality, safety, or outcome of any dental treatment provided by a clinic. Any agreement for dental services is solely between you and the clinic. We encourage you to independently verify clinic credentials and consult with a qualified dental professional before making treatment decisions.

8. Intellectual Property

All content on the Service — including text, graphics, logos, images, and software — is the property of Smilejet LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

INFORMATION ON THE SERVICE IS FOR GENERAL INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE MEDICAL ADVICE. ALWAYS SEEK THE ADVICE OF A QUALIFIED HEALTHCARE PROVIDER REGARDING ANY MEDICAL OR DENTAL CONDITION.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMILEJET LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SMILEJET IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) USD $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Smilejet LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, all licenses granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination (including Sections 8–12) will survive.

14. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmileJet regarding the Service.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
• Assignment: You may not assign these Terms without our prior written consent. We may assign them freely.
